A UCC-1 financing statement is a public filing that gives notice of a creditor's interest in personal property — in this case, the solar equipment. When filed against real property, it can appear on title searches and affect your ability to sell or refinance your home.
How UCC Filings Affect Home Sales
When you try to sell your home, a title search will typically reveal any UCC filings related to your solar system. Buyers and their lenders may require the filing to be resolved before closing — which can mean paying off the solar loan, negotiating a transfer, or other steps that complicate the transaction.
Refinancing Complications
Mortgage lenders may require that UCC filings be addressed before approving a refinance. This can delay or prevent refinancing, or require additional steps that were not anticipated when the solar system was purchased.
Lease and PPA Transfer Issues
Solar leases and PPAs typically require the new buyer to assume the agreement — or require the seller to pay off the remaining balance. Some buyers are unwilling to assume a solar agreement, which can reduce your pool of potential buyers or affect your sale price.
